Terms of Service

Confibite is operated by Rafael Guedes, a sole trader, Portugal. In these terms, “Confibite”, “we”, “us”, and “our” refer to Rafael Guedes trading as Confibite. You can reach us at support@confibite.app. These terms govern your use of the Confibite website and application (the “Service”).

Confibite generates weekly meal plans for people managing histamine intolerance or mast cell activation syndrome (MCAS). Every ingredient in a generated plan is checked against a food-safety whitelist derived from the SIGHI histamine scale before it reaches you.

Confibite provides informational guidance only. This is not medical advice. Always consult your clinician about your specific dietary needs. Individual tolerance varies.

The Service does not diagnose, treat, or replace the advice of a doctor, dietitian, or allergist. You are responsible for confirming that any meal plan or food-checker result is appropriate for your own medical situation before you eat.

You must be at least 16 years old to create a Confibite account — this matches the digital-consent age floor set by the EU General Data Protection Regulation (GDPR). The Service is not directed at children under 16, and we do not knowingly collect data from them.

You are responsible for keeping your login credentials confidential and for all activity that happens under your account. Tell us immediately at support@confibite.app if you suspect unauthorized access.

Free tier. A free account gets exactly one meal plan, for one week, for the lifetime of the account. It cannot be regenerated, and single-meal swaps are a PRO-only feature. The shopping list generated from that one plan remains available.

PRO tier. A PRO subscription includes up to 6 new plan generations and up to 30 single-meal swaps per calendar month (UTC). These quotas reset on the first of each month and do not roll over. A plan generation still counts against your quota even if the request fails after the underlying AI call was already made.

PRO subscriptions are billed by Polar, acting as Merchant of Record, at €7/month or €63/year. Polar handles payment collection, invoicing, and tax on our behalf, and Polar's own terms apply to the payment transaction itself. Subscriptions renew automatically until cancelled; you can cancel or manage your subscription at any time from your account page.

Right of withdrawal. If you are an EU consumer, the Consumer Rights Directive gives you a 14-day right to withdraw from a purchase without giving a reason. Because Confibite is a digital service that starts providing value immediately after payment (an active PRO subscription), by subscribing you expressly request immediate performance and acknowledge that you lose the right of withdrawal once the Service has been fully performed, or as soon as performance has begun with your express request, in line with Article 16(m) of Directive 2011/83/EU.

You agree not to: scrape or bulk-extract data from the Service; circumvent or abuse the plan-generation or meal-swap quotas; use the Service to generate content for a purpose other than your own meal planning; attempt to access another user's account or data; or interfere with the normal operation of the Service.

Meal plans and swaps are generated by a large-language model and checked against our ingredient safety whitelist before being shown to you. That check confirms every ingredient is on the whitelist at or below your chosen strictness level — it is not a guarantee that a specific meal will suit you personally. Individual tolerance varies. Treat every suggestion as a starting point for your own judgment, not a guarantee.

We aim to keep the Service available and reliable, but we do not guarantee uninterrupted access. The Service may be unavailable for maintenance, outages at a sub-processor (for example Supabase, Anthropic, or Vercel), or other reasons outside our control.

To the extent permitted by Portuguese law, Confibite is provided “as is” and we disclaim liability for indirect or consequential losses arising from your use of the Service. Nothing in these terms limits or excludes liability that cannot lawfully be limited or excluded under Portuguese consumer-protection law, including liability for death or personal injury caused by negligence, or for gross negligence or wilful misconduct.

We may update these terms as the Service evolves. We'll update the effective date and version above when we do. Continuing to use the Service after a change takes effect means you accept the updated terms.

These terms are governed by the laws of Portugal. If you are an EU consumer, this does not deprive you of the protection afforded by mandatory provisions of the law of your country of residence, and you may bring a dispute before the courts of your own country of residence or before the competent Portuguese courts.
